We urge you to read this document carefully as you will be asked to declare your acknowledgement and acceptance of it when placing any orders.

The Conditions of Sale set forth herein govern the offer and sale of products on the website www.siniscalchiceramics.it

ON-LINE ORDER.

The online order determines acceptance of the terms and conditions set forth herein and constitutes a contract between the Buyer and siniscalchiceramics.co.uk, who shall be a person of legal age, for the purchase of the products listed in the online catalog of the siniscalchiceramics.co.uk website.

siniscalchiceramics.co.uk may amend, without prior notice, the General Conditions. Such changes, will be effective as of the day of their publication on the Site. Purchase orders submitted to siniscalchiceramics.it prior to the publication of the aforementioned changes will be subject to the General Conditions in force at the time of the conclusion of the sales contract.

Purchases made on sitoweb.it are governed, as far as not expressly provided for in the following conditions of purchase, by Legislative Decree No. 185 of May 22, 1999 on the protection of consumers in respect of distance contracts.

ONLINE PRODUCT FEATURES

The characteristics of the products are indicated in the online catalog and are visible at the time of choosing and filling out the order before the conclusion of the submission procedure.
Prices (including VAT and any other taxes and duties for Italy) are indicated next to each product in the online catalog excluding shipping costs (except for the periods of promotion “Free Shipping”). siniscalchiceramics.it is not responsible for packaging of different color and / or serigraphy made by the manufacturer as a result of packaging change operations.

The visual representation of the Products on the Site, where available, generally corresponds to the photographic image of the same and is for the sole purpose of presenting them for sale, without any express or implied warranty or commitment on the part of siniscalchiceramics.it as to the exact correspondence of the image depicted on the Site with the actual product, especially with regard to its dimensions and/or aesthetic aspects.

The offer of Products and Services siniscalchiceramics.it is addressed to both consumer users and other users. Consumer users are defined as persons who purchase the Products presented on the Site for purposes unrelated to the entrepreneurial or professional activity they may carry out in accordance with the provisions of Legislative Decree No. 206 of September 6, 2005 (the “Consumer Code”).

For the purposes of these General Conditions, a person is not considered a Consumer who, when purchasing a Product or Service, expressly indicates in the notes of the personal data that he/she belongs to the category “Companies, entities, professionals with VAT registration number”, at the same time entering his/her own VAT registration number.

Where no express reference is made to the Business category, the provisions of the General Conditions and Special Conditions apply indiscriminately to all users who purchase Products through the Site are Consumers.

Companies have several consumer rights and guarantees.

PRICE OF PRODUCTS

The prices published on the homepages or in the various sections of the Site dedicated to each individual Product are inclusive of VAT and do not include any taxes, duties and duties applicable in the country of destination of the Products where this is different from Italy. These costs, which differ from country to country, are the responsibility of the Customer, who is responsible for verifying the amount with the competent customs authorities.

To the price of the individual Product must be added the cost of each shipment, the amount of which may vary depending on the mode of delivery and payment, as well as in relation to the country of destination. Said increases may depend on – among others – increases decided by siniscalchiceramics.it’s suppliers. For Sales Contracts concluded before the publication of the aforementioned changes, but still being executed, the prices in force at the time of receipt of the Order shall apply

CONTRACT CONCLUSIONS

The moment the order is transmitted by the Buyer to siniscalchiceramics.co.uk the contract of the General Conditions of Purchase shall be deemed accepted and binding.

siniscalchiceramics.co.uk may then send the FINAL CUSTOMER a rejection of the order and reserves, in its sole discretion, the right to cancel any order in the event of material errors related to the Customer’s order or information sent by the Customer through the site: siniscalchiceramics.co.uk. (E.g. Price of the selected Product conspicuously wrong, non-existent e-Mail Address etc…)

Upon receipt of the Order, siniscalchiceramics.it sends the Customer an e-mail of confirmation of receipt containing the details of the Order and all the data relating to the purchase or the type of Products requested and the relevant costs, as well as the Customer’s personal data and contact details

The Customer undertakes to verify the correctness of its personal data and promptly notify siniscalchiceramics.it of any changes. Receipt of the e-mail confirms the Customer’s acknowledgement and acceptance of the General Conditions and Specific Conditions.

Once siniscalchiceramics.it has received acceptance of the Order, it will ship the selected Products, which will be communicated to the Customer by e-mail.

PRODUCT DELIVERY AND ORDERS

The Site indicates the total delivery time for the Product ordered by the Customer to enter the full availability of siniscalchiceramics.it, be ready for shipment and delivered to the Customer. Therefore, for the delivery of the Product ordered to the Customer it will be necessary to consider the times indicated. The times of availability and delivery may vary from what is reported, either due to simultaneous access of users and exhaustion of the product, or as dependent on third party suppliers and not controllable. siniscalchiceramics.it, therefore, does not commit, nor does it guarantee full compliance with the delivery times indicated on the Site and/or in the Order, nor will it be held responsible for any delays.

In case of any unavailability, even temporary, of one or more products ordered, siniscalchiceramics.it will inform the Buyer of the unavailable products and the consequent updating of the amount. In case of prepayment of the goods, through the methods described below, the customer may either add products to replace those missing or request a refund of the amount equal to the missing products. In this case, the customer must communicate the bank details and promptly siniscalchiceramics.it undertakes to return the extra amount paid within 30 (thirty) calendar days.

In case of an error of an order of one product, and further order of another different product, if made the payment of the first, must be made eventual balance of the amount of the second product, if higher than the first, or will be credited by difference of the cost of the new product than the first.

Should the delivery time of the Product be delayed with respect to what is indicated by way of example on the Site, siniscalchiceramics.it, within 30 days of receipt of the Order, will send the Customer appropriate notice by e-mail as soon as it becomes aware of the event.
No responsibility, for any reason whatsoever, may be charged by the Customer to siniscalchiceramics.it, in case of delay in the fulfillment of the Order or in the delivery of the Product.
siniscalchiceramics.it invites the Customer to contact the Customer Service Department where any delays occur in the retrieval and shipment of the Products.

SHIPPING PRODUCTS

All shipments of Products will be at the risk of siniscalchiceramics.co.uk The risk will transfer to Customer upon delivery of the Products.

For each Contract of Sale made through the Site, siniscalchiceramics.co.uk will issue the relevant legally required accounting document relating to the Products and/or Services purchased. Such documents will be sent inside the package. It will not be possible to make any changes to the accounting document after it has been issued, nor will it be possible to issue this document if a Customer has not indicated his or her V.A.T. number or Tax Code.

In order to make proper delivery of the Products ordered, the presence of the Customer or their designee is always required. If none of them can be found at the time and place of delivery, the courier will leave a notice of second delivery for the next business day. The execution of the Order will remain suspended at the courier’s branch and if delivery is not possible, after 5 days the Product will return to the warehouses of siniscalchiceramics.it. Once returned from siniscalchiceramics.it, the Customer will be contacted by Customer Service and can decide whether to make a second shipment or request a refund of the Order excluding shipping costs of 10(ten) euros.

siniscalchiceramics.it does not assume any responsibility for inefficiencies attributable to force majeure such as accidents, explosions, fires, strikes and/or lockouts, earthquakes, floods and other similar events that would prevent, in whole or in part, to give execution in the agreed time to the contract

In cases of force majeure, unavailability of means of transport, unforeseeable events, siniscalchiceramics.it reserves the right to terminate the Contract of Sale or to split, postpone or cancel, in whole or in part, the scheduled delivery, where said events cause a delay in deliveries or make them difficult or impossible and/or cause a significant increase in their cost to siniscalchiceramics.it. In such cases, it will be the responsibility of siniscalchiceramics.it to provide timely notice of its determinations to the Customer’s e-mail address. The latter, in such cases will be entitled to obtain the refund of any price paid, excluding any further claim or compensation, for any reason, against siniscalchiceramics.it.

Delivery of the product to areas that are inconvenient or difficult to reach by the express courier will have variations in delivery costs, always communicated to the customer by siniscalchiceramics.it.

If the user’s data is incomplete or otherwise inaccurate (so as to make it impossible to deliver the package), siniscalchiceramics.it will not process the order and will cancel the order by email.
siniscalchiceramics.it will do everything possible to have the products delivered to the consumer within the specified time.
The consumer is invited to contact siniscalchiceramics.it in case of delay in delivery and in any case to report any inefficiency detected.

DELIVERY TIME

We strive to deliver your order within 2-3 business days for Italy upon shipment of the product. It should be noted that delivery times may vary due to causes beyond our control, i.e. force majeure, critical traffic and road conditions in general or by act of the Authorities.

METHOD OF PAYMENT

siniscalchiceramics.co.uk provides as a method of payment to be chosen when concluding the order:

• Payment by bank transfer in advance (the details will be communicated by e-mail at the conclusion of the order)
• PayPal
• Scalapay*
• Cash on delivery (payment will be made upon delivery)

Inside the package will be included the receipt and if required the accompanying invoice relating to the order, with details of the products purchased and the relative prices of shipping costs, taxes depending on the country of belonging that is not Italy.

Supplies can be made to companies, institutions, etc.

siniscalchiceramics.it is not responsible for any fraudulent and illegal use that may be made by third parties, of credit cards, and other means of payment, when paying for products purchased on the site www.siniscalchiceramics.it

The contract of sale between the Customer and siniscalchiceramics.it is understood to be concluded in Italy and governed by Italian Law even by a Foreign customer. For the resolution of civil and criminal disputes arising from the conclusion of this contract of sale at a distance, if the Customer is a consumer, the territorial jurisdiction is that of the court of reference of the town of Nocera Inferiore.

RIGHT OF WITHDRAWAL

Legislative Decree 206/2005 on the protection of consumers in respect of distance contracts provides the possibility for consumers to exercise the right of withdrawal.
This right consists in the possibility, exclusively in favor of the consumer, to withdraw from the purchase unconditionally, that is, without having to provide siniscalchiceramics.it any explanation of the products purchased from siniscalchiceramics.it within a period of 14 calendar days from receipt of the goods.
siniscalchiceramics.it will reimburse the consumer for any amount already paid for the purchase of the products, except for the cost of delivery and return of the purchased item(s), which shall remain the responsibility of the Purchaser.

The right of withdrawal can be exercised at any time after completing the purchase procedure and in any case within 14 calendar days, by notifying siniscalchiceramics.it of the desire to exercise the right itself and providing the following data:

• Invoice number and date or alternatively number of the order placed.
• in case of partial withdrawal, description and quantity of the products intended to be returned
• Bank details on which to obtain the refund transfer (CAB CODE- ABI CODE- BANK ACCOUNT). In case the account holder is different from the invoice holder, this must be indicated.

The notice of withdrawal and the above required data can be sent to siniscalchiceramics.it in the following ways:

To the same address of siniscalchiceramics.it, within 10 days of receipt of the goods, the consumer must arrange for their return (total or partial).

Returned products may be shipped by any means of the Buyer’s choosing to the address of siniscalchiceramics.co.uk, which, however, will not under any circumstances accept return shipments freight collect or COD unless previously approved by siniscalchiceramics.co.uk itself.

Once the products subject to withdrawal have been received siniscalchiceramics.it will promptly, and in any case no later than 14 calendar days, refund the sums paid by the Purchaser.
In order to validly exercise the right of withdrawal, the Consumer must comply with the following terms and conditions:

• withdrawal may also apply limitedly to individual Products covered by a single Contract of Sale, it being understood that the Consumer may not exercise withdrawal limitedly to a part of the individual Product purchased;
• all Products for which the Consumer has exercised the right of withdrawal must be intact in the original packaging, complete in all its parts including packaging material, any seals affixed, as well as any ancillary documentation;

if the Product for which the right of withdrawal has been exercised is received by siniscalchiceramics.it damaged, the latter will be obliged only to notify the Consumer in order to allow him, where possible, to exercise his right of recourse against the courier chosen for the return of the products.

siniscalchiceramics.it shall not be liable under any circumstances for damage, theft or loss of returned Products, until the return of the same. Any risk will, therefore, be borne exclusively by the Consumer.

Items will have to be returned:

• properly packed in their original packaging, in perfect resale condition (not ruined, damaged or soiled) and equipped with all its accessories, if any, instructions for use and documentation;
• equipped with the transport document (present in the original packaging), so that siniscalchiceramics.it can identify the customer (Order number, first name, last name and address);
• Without manifest signs of use. That is, they should not bear any signs of prolonged use (more than a few minutes) in excess of the time required for a test and should not be in such a state that they cannot be resold.

Where the returned item does not comply with the requirements of the preceding paragraph, the withdrawal will not be effective.

Items must be returned in new or unused condition and contain all original materials included with the shipment.

All packages must be sent via a traceable method. We are not responsible for packages lost in transit. Please be aware that shipping charges are non-refundable.

Once the integrity of the returned Product has been verified, siniscalchiceramics.it will refund the Consumer the full amount paid for the Product(s) referred to in the Contract of Sale subject to withdrawal, no later than 30 days from receipt of the same. The refund will be made using the credit card details provided by the Consumer at the time of formulation of the Order, or by bank transfer to the coordinates indicated by the Consumer.

If the Consumer violates, in whole or in part, the provisions dictated regarding withdrawal from these General Conditions, the Contract of Sale shall remain valid and effective and siniscalchiceramics.it shall return the Products unduly returned to the Consumer, charging the latter for the relevant shipping costs.

siniscalchiceramics.it has the right to withdraw from each Contract of Sale concluded by the Customer or Consumer, giving the same written notice by e-mail and registered letter a/r, as well as may not accept any Order from users or Customers who have implemented irregular conduct, are suspected of conduct contrary to the law or is imposed by an order of a judicial authority.

WARNING: the right of withdrawal can be exercised only if the goods are perfectly intact in all its parts and not opened or used, carefully packed so as to preserve the original wrappings. Should siniscalchiceramics.it receive return items damaged or tampered with, that is, without having followed the above shipping precautions, it will not refund the amount paid for the purchase of the products.

WARRANTY AND RETURNS

If the Products or Services enjoy a conventional warranty recognized by the manufacturer, any defects, faults or deformities must be reported directly to the manufacturer as indicated on the Product packaging or in the illustrative brochure. Except as required by mandatory provisions of law, siniscalchiceramics.it declares that it has no responsibility with regard to flaws, defects or deformities in the Product. This is without prejudice to the warranty for the Consumer pursuant to Legislative Decree 206/2005.

The Consumer in this case must, report the defect found to siniscalchiceramics.it Customer Service within the period of 2 (two) months from the date of arrival of the product.

siniscalchiceramics.it will use reasonable efforts to replace, at its own expense and within a reasonable time, the defective product. Should this not be possible, or prove excessively burdensome for siniscalchiceramics.it, the Consumer shall be entitled to terminate the Contract of Sale and, consequently, to obtain a refund of the sums paid for the purchase of the Product excluding shipping costs, any further liability of siniscalchiceramics.it for any reason whatsoever remaining excluded.

If the Customer detects any discrepancies between what was ordered and what was received, and in particular, finds any problem inherent in the physical integrity, correspondence or completeness of the products received, he must promptly inform the Customer Service of siniscalchiceramics.it within 10 working days. The Customer Service of siniscalchiceramics.it will provide the necessary guidance to solve the problem, and where possible, the shipment of the missing items, the replacement of defective items or their reimbursement.

Nota Bene:

Before shipping the product purchased by the Buyer, the Staff of siniscalchiceramics.co.uk proceeds to quality check the product, carefully and meticulously verifying that it is in the absence of manufacturing defects and scratches.

Factory defects are not attributable to wear and tear of the product due to use, but found in a short time.

Accidental Breakages caused by the Buyer are not covered by warranty.
